Terms Of Business:
First Impressions Discos terms of business are divided into
parts. All parts shall apply to any and all contracts negotiated
and shall be the basis for any and all bookings.
Part A - Definitions:
1. First Impressions Discos is a trading name of CEE Worldwide
Entertainment.
2. Any person or organization transacting business with or
engaging services from First Impressions Discos shall hereafter
be known as 'The Client'.
Part B - Booking And Payment Terms:
1. We will hold a date for the intended client for an initial
period of 7 days from the date of the enquiry subject to our
being available in the first instance. If The Client does
not confirm the booking within this time period we reserve
the right to accept other enquiries and/or bookings. Once
a date is confirmed the non refundable deposit at the rate
indicated in our pricing schedule shall become payable immediately
and contracts for the booking shall be issued. Non receipt
of/nor return of a signed contract shall not constitute a
cancellation by either party. Cancellations may only be made
in accordance with the cancellation terms and the deposit
shall still be payable under any and all circumstances.
2. A booking is not considered final until you receive our
confirmation by email or by post. The Contract shall specify
payment details, arrival time, and start time (The start time
shall be the time that music commences). Contracts shall be
issued by our parent company CEE Worldwide Entertainment Agency
and their Terms Of Business shall also apply.
3. All outstanding fees or balances are payable by cheque
no later than 10 working days before an event (cheque must
be received by us within this time frame) or in cash prior
to the DJ commencing entertainment of the evening unless agreed
otherwise. You may also pay by credit or debit card or by
bank transfer using PayPal, if you opt to make payment via
PayPal any outstanding payments must be made at least 7 days
prior to the event. In the event that payment is made by cheque
you must make sure that there are sufficient funds to cover
its encashment. If a cheque is refused and payment not credited
to our account, we will not attend the function, we will invoice
you for the full amount due and we will add a surcharge of
£28.00 + VAT to cover bank charges and our administration
costs. Non clearance of a cheque shall be regarded as a breach
of contract by The Client and treated accordingly.
4. In the extremely unlikely event of the disco having to
cancel, any monies paid to us by The Client shall be refunded
in full (this will include any deposit which would normally
be non-refundable). We will also endeavor in helping to find
a replacement DJ or Disco. (This will be the full extent of
the disco's liability or that of the parent company CEE Worldwide
Entertainment Agency)
5. All fees are subject to VAT at the prevailing rate.
6. All cheque's must be made payable to
CEE Worldwide Entertainment.
Part C - Cancellations
1. All cancellations by a client must adhere to the following
rules:
- All cancellations must be made in writing
- All cancellations must quote the relevant contract number
- Cancellations will only be accepted from the person who
made the original booking
- Cancellations must clearly state the reason for the cancellation
- Cancellations shall be subject to cancellation fees at
our discretion
- The date of a cancellation shall be the date upon which
it is received by us, not the day on which it is sent
- All cancellations by e-mail must be sent to cancel@wedding-disco-hire.co.uk
and should request a read acknowledgement
2. Cancellation fees shall be at our discretion, based on
the date received by us and calculated using the following
charging scale:
- Within 2 weeks (14 days) of booking up to 100% of outstanding
balance
- Within 3 weeks (21 days) of booking up to 75% of outstanding
balance
- Within 4 weeks (28 days) of booking up to 50% of outstanding
balance
- Within 6 weeks (42 days) of booking up to 25% of outstanding
balance
Any cancellation fees charged will be based on the likelihood
of our finding and booking another event within the time period.
3. In the event that First Impressions Discos finds it necessary
to cancel a booking all monies paid by The Client to First
Impressions Discos (including the deposit) shall be refunded.
First Impressions Discos shall only ever be liable to The
Client for a sum up to and including the value of any monies
paid by The Client to First Impressions Discos. First Impressions
Discos and any associated companies shall not be liable for
any compensation claims arising from a cancellation.
4. First Impressions Discos and any associated companies
shall not be held liable for consequential loss The Client
may suffer in the event that a Booking is cancelled.
Part D - Setup And Safety
1. We require access to the function room at least 1 hour
and 30 minutes prior to the start time and up to 60 minutes
to pack up and vacate the venue. It is your responsibility
to inform the venue of this and to make sure that this will
not be problematic. Large shows may take more time to set
up and pack up and should this be the case you will be advised
of this prior to taking the booking.
2. Where early setup is required it will incur a rate specified
in our pricing schedule. Equipment will be set up and tested.
The site should then be non accessible to others (ie locked),
and should any tampering of the equipment cause it to fail
later then First Impressions Discos shall not be held responsible.
This shall also apply where PA systems are supplied for speeches
etc.
3. The Client shall make sure that the venue can meet the
power requirements of the equipment to be used, so that no
power supply is overloaded. It is The Client's responsibility
to ensure the venue is equipped with at least 1 safe, working
standard double socket on a 32Amp ring main, two are preferred.
These should be in the immediate vicinity of where the disco
is to be set up. If we are required to use CEE form power
connectors we can do so but must be notified of the following:
- Rating of supply socket ie 16Amp, 32Amp, 64Amp or 125Amp
- The type of connection ie Single Phase or Triple Phase
If unsure of any of these details The Client should make
sure we have the contact details of the venue or company supplying
the electrical feed so we can make sure. We will work from
information supplied so if it is incorrect we accept no responsibility,
subsequently in the wrong information is supplied which results
in the event not being able to take place First Impressions
Disco and any of its associated companies shall not be held
liable.
4. We take our clients safety and ours seriously, and should
an adequate power supply not be available we reserve the right
to limit the equipment that we use or to cancel the engagement
if we feel that by going ahead people may be put at risk.
If a venue is found to be unsuitable or dangerous and we are
forced to cancel then no refund shall be payable.
5. The Client also agrees that First Impressions Discos,
at all times, will allow adequate traveling time to fulfil
their hire obligations but accept no liability for late starting
due to any act of God, War, Strikes, Industrial Disputes or
Accidents, Fire, Flood, Drought, Adverse Weather or other
cause beyond our control. The Client would be advised of this
situation as soon as possible. The Client then and only then
would have the choice of continuing with our services at the
fully agreed price or canceling our services without cancellation
charges being applied. In such circumstances First Impressions
Discos will commence the show at the earliest opportunity.
In the event of vehicle breakdown we will use another vehicle
if one is available. If another vehicle is not available we
will do our best to hire one at no charge to The Client so
as to fulfill our booking obligations. Should it be that a
breakdown occurs and no other vehicle is available, and that
it is not possible to hire one, we may cancel the booking
and refund the full amount paid to us by The Client. In such
instances The Client waives any and all rights to seek further
compensation in any form, including litigation.
6. Where a reception is running late hindering setup of the
disco by First Impressions Discos The Client agrees that First
Impressions Discos shall not be held responsible, and that
full payment is still required. First Impressions discos under
these circumstances agrees to set up as soon as possible and
to commence the show at the earliest opportunity.
7. First Impressions Discos shall not be held responsible
for any loss of electrical power either permanent or temporary.
8. If, upon arrival at the venue, First Impressions Discos
are unable to perform the service/s for which they have been
contracted because:
- Access is refused or impossible
- The venue has been misrepresented by The Client
- For reasons outside the control of First Impressions Discos it is impossible
to set up
it shall be regarded that The Client is in breech of contract
with First Impressions Discos. In such an event First Impressions Discos shall be deemed
to have fulfilled its contractual obligation to The Client
and reserves the right to leave the venue forthwith. For the
avoidance of doubt, it shall be the responsibility of The Client to ensure First Impressions Discos and its agents are able to perform
their part of the Contract and that details upon which the
Contract is based are entirely accurate. Failure to do so
will terminate the Contract and any responsibility First Impressions Discos
has to The Client.
Part E - Damage To/Theft Of Equipment
And Threats To Staff
1. The Client shall indemnify First Impressions Discos for
any damage caused to our equipment by themselves or any guest
and shall agree to pay any replacement cost if necessary at
current retail price.
2. The Client is responsible for any theft of equipment caused
by guests attending your event. The Client is also responsible
for any theft by persons unknown arising from equipment being
set up and left prior to an event where the set up location
is not properly secured.
3. The Client will be responsible for pursuing the matter
with the individual/s involved in any instances arising at
an event.
4.Should replacement parts be available then First Impressions
Discos shall at its discretion charge for these parts as well
as the repair time costs. Should the cost of repair exceed
the cost of replacement then First Impressions Discos shall
replace the item instead, so long as it is still available.
5. This indemnity does not cover such parts that are liable
to fail in ordinary usage such as bulbs, these items will
be replaced by First Impressions Discos at its own expense.
6. It is The Client's responsibility to ensure the good behavior
of their guests. If at any time, before or during the event,
we deem our persons or property to be under threat, we reserve
the right to terminate our services without further notice.
In these circumstances, no refund will be made. Violence against
any member of First Impressions discos or our equipment will
not be tolerated under any circumstances.
7. All dialogue with First Impressions Discos should be conducted
in an orderly and civilized manner. Insulting, demeaning,
confrontational and aggressive behavior towards the company's
staff will not be tolerated.
Part F - Client Liaison, Co-Ordination
And Children
1. Although respectful of any of your guests suggestions that
may be made on the night First Impressions Discos will remain
responsible to the person who placed the booking or their
appointed representative. This avoids the possibility of contradictory
instructions. In a case where instructions given to us may
cause problems with other attendees we will refer them to
the person we are responsible to or the appointed representative
to deal with the matter.
2. First Impressions Discos will always coordinate our services
with other professionals The Client may have engaged such
as photographer, catering staff or other entertainers etc.
First Impressions Discos will respond to polite requests as
appropriate but do not take absolute instructions from a third
party. This avoids contradictory instructions and conflicting
interests.
3. The Client will provide sufficient adult supervision of
the children attending the event.
4. The supervising adults will ensure that the children do
not interfere with the disco equipment or prevent the DJ from
performing his duties of playing music and entertaining all
other guests.
Part G - Sound And Lighting
1. Equipment designed to play loud music or to produce loud
sounds (music and public address systems) emit sound pressure
waves that can cause a nuisance and are capable of inflicting
physical damage to structures and/or hearing which can be
irreparable. First Impressions Discos will not knowing use
equipment at an output level or in such a manner that will
deliberately do damage to health or structure or cause a nuisance.
2. First Impressions Discos will not work in any venue where
we have to plug into power sockets controlled by a sound limiter.
Sound limiters typically cut power to these sockets if tripped
which can irrevocably harm our equipment. We may at our discretion
work such a venue ONLY if said venue allows us to use sockets
not controlled by any sound limiter, and the venue must confirm
this in writing before we will consider doing so. Should we
agree to carry out a contract at such a venue and are subsequently
required to use sockets controlled by a sound limiter we reserve
the right to refuse to perform. The subsequent requirement
to us having to use such sockets will be deemed a breach of
contract for which The Client shall accept full and total
responsibility, and full payment will still be required.
In the event a sound limiter is installed after a contract
has been accepted and issued, the installation of the limiter
will be classed as an amendment to the contract. First Impressions
may impose limitations such as those listed above or choose
to cancel the contract, without penalty.
3. Light shows may include the use of various types of lighting.
The Client should check that guests attending the venue do
not suffer from medical conditions exacerbated by bright or
flashing lights. First Impressions Discos will rely entirely
on instructions from The Client on appropriate use. The Client
shall at all time remain responsible and ensure First Impressions
Discos remain informed. Please note that whilst strobe lights
are a common cause of photo sensitive epilepsy, the condition
can be triggered by other lighting and even monitor screens.
First Impressions Discos cannot be held liable for any seizure
or other effect that may be suffered by any guest.
Part H - General
1. All fees are quoted on the basis of suitable unloading
area and the availability of adequate parking . It is The
Clients responsibility to inform us of parking restrictions
such as red routes etc. When access and parking are difficult,
additional logistical arrangements may be needed and a extra
charge may apply. Where parking restrictions may be a problem
then it shall be The Clients duty to obtain and pay any appropriate
costs for any and all permits that may be required. Any permits
must be made available to First Impressions Discos prior to
the event. The Client indemnifies First Impressions Discos
against any and all charges such as fines and/or legal costs
which may arise from parking restrictions or The Clients failure
to obtain the necessary permits or permissions.
2. All persons signing any contract must be at least 18 years
of age.
3. It is strictly forbidden for anyone else other than a
person authorized by us in writing to use or move our equipment
without our express permission, this extends to vehicles,
trailers and all company property.
4. First Impressions Discos reserve the right to vary the
original Booking in the interest of fulfilling its contract
with The Client. In the event that a variation proves necessary
First Impressions Discos shall endeavor to supply goods or
service that satisfy or exceed The Client's original requirement.
5. Whilst every reasonable precaution is taken First Impressions
Discos will not be held liable for its inability to fulfill
a Contract through failure or malfunction of equipment.
6. It is The Client's responsibility to organize insurance
cover for their event on top of the public liability insurance
held by us and for that cover be of an adequate amount to
indemnify we, First Impressions Discos of any losses that
are the result of the hirer's event.
7. Conditions allowing we always aim to perform at any venue
to the highest possible standards.
8. We always try to give the very best advice or information
when asked to do so by any client based on our many years
of experience but any information given should only ever be
considered as advisory.
9. We will make sure that all our equipment is suitable for
the job for which it is intended. We will make sure that our
equipment is insured and the client shall not be held liable
for any loss or damage outside of the indemnity already stated.
All our equipment where required shall have a current and
valid PAT certificate (PAT shall be carried out on a yearly
basis). All equipment will be adequately maintained and will
be of a standard to satisfy the "Health and Safety At
Work Act 1974": "The Provision and Use of Work equipment
Regulations 1998".
10. We are licensed for the use of digital music for public
performance and shall make sure that all such licenses are
renewed as and when applicable.
11. We will carry a wide range of music covering extensive
styles and tastes. If you have specific music requirements,
please contact us to discuss them should you require something
a little different, and we will endeavor to gain access to
it for your event.
12. If any provision of these Terms Of Business are determined
by a court of competent jurisdiction to be unenforceable,
such determination shall not affect any other provision hereof,
and the unenforceable provision shall be replaced by an enforceable
provision that most closely meets the commercial intent of
the parties.
13. Failure by First Impressions Discos to exercise any of
its rights shall not constitute a waiver of these rights of
any proceeding or succeeding breach of any contract.
14. Images and video used in this site are for aesthetic
and promotional use only and shall not form the basis of any
contract, nor may they be relied upon in the event of any
litigation.
15. Whenever the context so admits, words importing the masculine
shall include the feminine and the singular number shall include
the plural and vice versa as appropriate.
16. All contracts to which these conditions apply shall be
construed in accordance with English Law.
